Dryer vs NFL Films Update

In case some of you missed it last year, there was a lawsuit filed on behalf of all retired football players to recover royalties from the NFL and NFL Films for re-packaging and distributing footage of games from years past. The suit was initiated by attorney and former player Bob Stein (1969 – 1975 Kansas City Chiefs, LA Rams, Minnesota Vikings and San Diego Chargers) and filed in August 2009 and it was originally led by plaintiffs Fred Dryer, Jim Marshall, Elvin Bethea, Joe Senser, Dan Pastorini and Ed White.

Since then, the case has gone through some changes that we’ve learned about through the many public filings available in the court system. We’ve noticed that Zimmerman & Reed is no longer representing this class (all of the plantiffs have apparently fired them) and we have also learned that Hausfeld LLP and Zelle Hoffman (both firms from the ongoing Eller Class action) have now added their weight and resources to keep moving this lawsuit forward with Bob Stein.

There’s going to be a lot of backpedaling as DeMaurice Smith begins to take control as the new Executive Director of the NFLPA. You’ll remember that when Gene Upshaw departed just a month before the NFLPA/Players Inc. trial was to start in September of 2008 so the judge postponed that start date until October 2008. In that time, Richard Berthelsen was appointed as acting Executive Director while their Board frantically started their search for a new Director.

The Congressional Confirmation Hearings for Eric Holder as Attorney General are going on right now. Most of the retired players have expressed their negative views about this mouthpiece and lobbyist for the NFL. Their fears of Holder running interference with ongoing Congressional investigations into the NFL’s mistreatment of its retired players need to be brought to the forefront to ensure that Holder will be forced to recuse himself from anything to do with the NFL. Better yet – after looking at some of the press coverage on the things he’s been involved with over the years, perhaps he shouldn’t be confirmed.

No doubt, Holder is one of the best lawyers money can buy… But surely there are better, more ethical attorneys (is that an oxymoron?) for the job?
