On Wednesday, February 15, 2012 at 1:30 p.m. your case will be argued against the NFLPA in front of Judge Susan Nelson in St. Paul, Minnesota. The NFLPA filed a Motion to Dismiss and this hearing will be to determine if your case is dismissed.

If you will recall, in September and October of 2011, 47 former NFL players, including 27 Hall of Famers (26 of whom who are listed in the NFL’s official encyclopedia as 300 of the greatest players in NFL history), representing every decade in pro football since the 1940′s, filed a class action lawsuit against the NFLPA. The class representatives represent virtually every position in football, and every category of NFL player – including vested, non-vested, Hall of Famers, forgotten players, and legends of the game. The lawsuit was filed on behalf of all former NFL players and seeks to increase the retirement benefits of all players – vested and non-vested

The NFLPA is asking that your case be dismissed against them. We will argue that your case deserves to be heard by a jury.

It would be great if the Judge could see a courtroom of retired players who are all in support of having your case get heard by a jury. So if you are available to make it to Minnesota to attend the hearing, I ask that you mark it on your schedule and come show your support for your case. It is particularly important that you attend if you live locally.

We’ve pretty much come to expect that nothing the NFLPA or the NFL does is ever straightforward or easy.
Another prime example popped up a couple of weeks ago when we first announced that the jury had ruled in favor of the plaintiffs in the NFLPA/Players Inc. lawsuit in San Francisco. Several people posted positive comments about this incredible effort by Herb Adderley, Bernie Parrish and Walter Roberts on behalf of thousands of retired players. Sadly, when the final revised list of players who were included in the suit was made public, many players came to realize that they had been completely left out. Again. Some of them may not have even received a GLA for their signatures; others may simply have been left off in error or even intentionally not contacted by the NFLPA/Players Inc.

Jeff Nixon remembered to bring his camera along to the trial in San Francisco and managed to get a few pictures outside of the courtroom during deliberations. Even before the verdict came in, everyone seems relaxed and happy to be there. Has anyone got any pictures of NFLPA Acting Executive Director Richard Berthelson or their attorney, Jeffrey Kessler, smiling?

Fellas,
A number of months ago I told you all that Gene had actually stated to a group of his gangsters the following: ” We don’t have to worry about dividing those assholes because they have divided themselves.” Let’s not let him be proven right.
I also stated to all of you some months back that I was a “Bernie Parrish Man” all the way. That has not changed. Upshaw, the NFLPA and the NFL feared – and fears – Bernie more than it does any man alive. That’s a fact. The NFL even offered to negotiate directly with the retired players if someone could get Bernie to “go away.” Ha ha ha. Fat chance of that ever happening. No one can dispute the commitment that Bernie, Herb and Walt had before any of the rest of us even dreamed that we could really take these Gangsters…
