 Disability Attorney John Hogan

Dear Dave,

I thought I would pass this along to you for posting, so that disabled players don’t get caught in a squeeze.  The Social Security Administration has started a massive review of individuals who are on disability benefits.  They are planning to do so on a scale that they have not approached in decades.  They are looking to cease the benefits of anyone who they feel is no longer disabled, either due to work activity; or, because they feel that their condition has improved to the point that they may be capable of returning to work.  “Younger individuals” – those under 50 years of age, will most likely those subject to possible cessation of benefits.  However, a person of any age (up to full Social Security retirement age) could be reviewed and ceased.

Monthly Social Security benefits and Medicaid and/or Medicare are vital for many thousands of Americans, and surely many retired NFL players.   In addition, if a retired player is also receiving NFL disability, that may be subject to review if their Social Security is ceased.  I am not sure how the Plan  will handle it, but in such cases they might send the player to an evaluation with one of the Plan’s “neutral” physicians.

Former NFL quarterback Dan Marino has withdrawn from a suit against the NFL. The suit says the league knew for years there was a link between concussions and long-term health problems. Scientists believe repeated head trauma can cause chronic traumatic encephalopathy, or CTE, a progressive degenerative disease of the brain. Symptoms include depression, aggression, and disorientation, but so far scientists can only definitively diagnose it after death. Here are a few of the former athletes who have been diagnosed with CTE.

In this Oct. 7, 2011 file photo, President Barack Obama, left, looks towards quarterback Jim McMahon, wearing headband, as he honors the 1985 Super Bowl XX Champion Chicago Bears football team during a ceremony on the South Lawn of the White House in Washington. A group of retired NFL players, including McMahon, says in a lawsuit filed Tuesday, May 20, 2014, that the league illegally supplied them with risky painkillers that numbed their injuries and led to medical complications.
