Dan Pastorini Gets the Boot from George Martin

Jan 15, 2012

Dave -
After reading over the NFL Alumni’s Group Licensing Agreement, I decided to notify them that I couldn’t – and wouldn’t – accept their GLA which has developed virtually no revenue whatsoever for retired players. In fact, it looks to be clearly designed to impact and damage the Dryer v. NFL lawsuit on behalf of all retired players. Next thing you know, I’m being told by George Martin himself that I could no longer be a member of the NFL Alumni!
I’d like to suggest that other retired players might not want to be NFL Alumni members …unless they want to support the NFL’s ongoing poor treatment of retired players. We don’t want to be paying for George’s new Escalade and we sure don’t want another repeat of Gene Upshaw’s GLA “One-for-You-and-One-Million-for-Me” deals. (Click on Dan’s membership cancellation to enlarge for easier reading.)

EDITOR’S NOTE: Dan sent us some additional clarification on his Alumni membership:
I tried to pay my dues online but it wouldn’t let me unless I checked the GLA box! I then e-mailed them and asked why I couldn’t join without agreeing to the GLA. They informed me I could send a check. Then I got George’s e-mail stating I was no longer a member.
We uploaded a copy of the NFL Alumni GLA to Scribd for viewing and printing and to make it downloadable. You can also click the Fullscreen button on the left side of the menu to enlarge it for easier navigation (hit the ESC key to close)

    Thanks for sharing this, Dan.

Most of us take this kind of treatment in silence. Words are easy to toss around while actions demonstrate “True Colors.”

Just to tell the whole story regarding Dan’s leaving the Alumni…

Below is bullet recap of the National Office interactions with Mr. Pastorini –

    * On 07/21/11 the National Office received a signed GLA from Mr. Pastorini.
    * On 11/7/11 Mr. Pastorini expressed concerns that signing GLA would have an impact on current lawsuits against the NFL and NFL Properties.
    * On 11/9/11 the National Office, along with Venable, LLP, responded to Mr. Pastorini’s concerns, stating
‘In speaking with our legal counsel, the NFLA GLA is specific to licensing retired players’ names and likenesses are not connected with any NFL intellectual property. Also, the GLA does not give any rights in retired players’ names and likenesses to the NFL. If a retired NFL player signs the NFLA GLA, there is no impact (direct or causal) to the Dryer class-action lawsuit against the NFL and NFL Films.’
    * On 01/04/12 Mr. Pastorini requested that his membership in the NFL Alumni be terminated, his GLA destroyed and the NFL Alumni not include his name in any licensing initiatives. The National Office provided Mr. Pastorini a full refund of his dues, as well as destroyed his GLA, per his wishes. In addition, at that time Mr. Pastorini was informed that membership in the NFL Alumni Association was not predicated on signing the GLA. If Mr. Pastorini wished to continue his membership and not be a part of the GLA, such action would be gladly accepted.

For Pastorini to spin the truth unto that which is unrecognizable…is a crime against every retired player, ever.

To paraphrase Rod Smith, “For Martin, Carter, Smith and Nixon to spin the truth unto that which is unrecognizable… is a crime against every retired player, ever.”

Let’s not forget that those GLA’s and membership dues that retired players pay to the Alumni association in part help to fund Mr. Martin’s – as well as Mr. Nixon’s – salaries, along with being underwritten by the NFL owners. So before everyone jumps to their defense, take that into consideration.

By the way, anyone that defends them for sneaking in that GLA Gene Upshaw-style is drinking the same Jim Jones Kool-Aid as Mike Davis has been drinking. They tried to slip the GLA release in under the table, got caught and called out on it and now are trying to deflect the blame or place negligence on the messenger… Dave’s blog.

And Rod, it really doesn’t matter if Dan or you spun the truth or not. Sneaking in the GLA or making membership contingent on signing the GLA is the real issue. I have better things to do with $100 than to fund George and Jeffs’ paychecks and sponsor lame golf tournaments.
