Update: Our Disability Program Questions

May 16, 2010

Over a week ago, I wrote and sent a letter with questions for Mary-Ann Fleming, Director of Disability Benefits for our Bert Bell/Pete Rozelle NFL Players Retirement Plan. You can read that earlier post by clicking HERE. The letters were mailed out by USPS Priority Mail to her and Larry Lamade at Akin Gump. Copies of the letter were also sent out to the NFLPA representatives on the Disability Board, as well as Roger Goodell (Chairman of the Disability Board) and DeMaurice Smith at the NFLPA.

.

USPS receipts indicated that the letters were received by Mary-Ann Fleming’s office as well as Larry Lamade’s office. I received this FedEx response from Mary-Ann Fleming’s office late last week and I have yet to hear back from Larry Lamade. (Click on the thumbnail to enlarge the letter for easier reading.) Looks like Ms. Fleming is away on business and vacation for a couple of weeks. We’ll keep everyone posted as things develop.

    Wonder why they couldn’t forward the letter to her since they copied her on the response? Keep up the good work!

    Dave:

    I guess they don’t look at mail from you or any of us as important communication. I know I sent Upshaw many a letter and never once received a reply.

    I wanted to let you know that I’m going to try to reopen my disabilty case with the NFL. I am looking for an attorney in Denver to help me out. I feel with the recent issues brought forward from the Amen Clinic that they just can’t push any of us away any longer. I’ve also opened a case in CA under their comp laws. Bernard Moore Gonzales has taken the case. He was recommended by Congresswomen Linda Sanchez. We need to keep the pressure on these robber barons.

    Thanks for your time and consideration.

    Larry,

    We certainly agree! There are 3 things that will force the NFL to refrain from their ongoing thievery from retired players and pay their long overdue bills:

    1) Bad publicity (exposing their fraud);
    2) Congress (to include IRS audit and loss of their anti-trust exemption);
    3) Class Action Lawsuit(s).

    The NFL has so much power, they are able to do just about anything they want (especially lying, cheating and stealing).

    Justice now for all retired players!

    Sincerely,
    Dave & Heidi Pear

    I recently had shoulder replacement surgery on March 3, 2010. After I came home, I called and talked with Ms. Fleming about rehab. I had my doctor fill out and sign the forms that I received from her office and then I mailed them off.

    Today is May 17, 2010 and I have yet to hear back from anyone in their office. Vacation?
