This story started a couple of weeks ago when I was reminded that Valerie Cross was the person listed as the Director of Player Benefits for the Bert Bell/Pete Rozelle NFL Players Retirement Plan. So I went ahead and called her office. My call got directed to her voicemail and I left a message asking her to call me back regarding some questions that I had about my benefits as well as my HIPAA/ERISA  rights. Here we go again. After the latest rounds of making it clear that I continue to support the need for independence, several retired players have been calling and writing to inform me that my name is once again being used to imply support for the Fourth & Goal/Alumni Alliance. At least now I can understand some of the confusion: many of you guys must have been wondering why I would be publicly stating my decision not to join the NFL Alumni organization when it appeared that I had been endorsing it.

Apparently, Fourth & Goal sent out a letter at the beginning of June (right after The Summit) to an unknown number of retired players to enlist their support of the new Alumni deal. It appears that not everyone got this letter since I know that a large number of us who attended the Summit never received it (so much for including ALL retired players, fellas). Also included with the 2-page letter were 5 pages from a “Confidential Business Plan” that caught my attention. The two most interesting pages are attached below (click on each page to enlarge for easier reading.) Important sections are highlighted and worth reading carefully. Both Marvin Cobb and I are listed as “Key members of the New Alumni Advocacy Group” along with other members of the current Board of Fourth & Goal.

After what seems like an eternity, Manett Phelps & Phillips and McKool Smith filed Motions in the Parrish, Adderley, Roberts vs. the NFLPA/Players Inc. class action lawsuit late last week for final review and court approval on August 20, 2009 by Judge Alsup. The documents just became available online so we’ve loaded them up on DocStoc once again for easier viewing and searching. The main part of the Motion outlines the basics of the case and subsequent settlement. The Exhibits outline the payment plan and schedules with the first payment scheduled for July 13, 2009 (they’ll miss that one!) and the second set for June 5, 2010.

It’s always interesting digging into the details: Turns out the settlement will be managed and distributed by Garden City Group which just happens to be right here in Seattle. Half of the funds (around $13 million) were placed into escrow on July 13th, the day this Motion was apparently filed. And then barring no problems, the balance will be placed into escrow on June 5, 2010 for distribution shortly after that. Another interesting detail from Page 7 of Exhibit 1: Players who elected to Opt-Out John Baker, Richard Yelvington, Lynn Chandnois, John Demarie, Dan Goich, Daniel Direnzo, James “Scottie” Graham, Deacon Jones, Steve Largent, Brig Owens, Ben Pucci, Donald Testerman and Andre Collins were all excluded from suit.

Gentlemen (and ladies) -

I think we’re long overdue for a short time out. I don’t often post personal editorials on this blog but after following the posts and comments back-and-forth since The Summit at the end of May, I’ve been thinking long and hard about taking a few minutes of everyone’s time to ask everybody to chill for a moment. In other words -  time for a time out.

I believe there’s no doubt that everyone has good intentions for the plight of retired players. Of that, I have absolutely no doubt after having known Dave Pear as a good friend over these past years and being honored to have been invited to The Summit. After finally meeting many of you face-to-face for the first time (and I certainly hope not the last!), I got to hear your stories firsthand and I experienced the passion that made this game what it is today. And it’s that passion that clearly drives each and every one of you guys today.

The Associated Press reports this morning that 20 current and former NFL players headed to Capitol Hill to lobby members of Congress to help avoid a lockout in 2011 if a new CBA is not reached. (Read that article by Frederick Frommer HERE.) De Smith told reporters that the players would remind Congress about the “gifts” Congress bestows on the league, such as an antitrust exemption for broadcasting contracts. Bob Grant

It seems as if there’s always someone ready to jump in to lead us and tell us what to do. You know – as if we were mindless, voiceless kids. We finally rid ourselves of Gene Upshaw and now here comes the so-called “New Alumni.” This is America and you and I are free to dash out and join the YMCA or PETA, the Taliban or Reverend Jim Jones – or any other group or individual – who advertise themselves as being “the way to the promised land.” That certainly doesn’t mean that we have to do so however; I personally believe we should be thinking independently and consciously considering all of our options before “signing on” with anyone.

We keep getting inquiries and comments on an almost daily basis asking about when the retired players will finally be receiving their Players Inc. settlement money. Since the settlement was first announced with great fanfare in early June at a well-covered press conference that included NFLPA Executive Director DeMaurice Smith, plaintiffs’ attorney Ron Katz and plaintiff Herb Adderley, few details have been available on how, what, when, where and why. We need a Jerry Maguire to remind the NFLPA/Players Inc. to Show Us the Money!
